This Attachmate^® Reflection^® Secure FTP software, including any "online" or electronic documentation (collectively "Software") is being furnished to you as an Update for one or more Attachmate software product(s) you have previously licensed ("Attachmate Product(s)").  The Software is licensed under the same terms and conditions contained in the Attachmate Software License Agreement ("License") you received with the Attachmate Product(s), except that the Limited Warranty and Limitation of Liability clauses contained in the License are replaced and superceded by the below stated No Warranty and Limitation of Liability paragraphs which apply to the Software, and the following usage rights terms are added. You may make copies of the Software and use such Software copies if you comply with the following conditions: (i) the number of Software copies you are permitted to make is limited to the number of Attachmate Product Licenses you (or your company) has purchased; and (ii) any Software copy installed on a device that does not also have a validly licensed copy of an Attachmate Product will be accounted as used in lieu of one authorized copy of  the Attachmate Product(s), with the effect of reducing the total authorized count of Attachmate Product(s) copies. If you do not agree to be bound by the terms and conditions of the License and the amendments to the License set forth herein, then you are not authorized to use the Software.

NO WARRANTY.  THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.  THE ENTIRE RISK AS TO THE USE, OPERATION, PERFORMANCE AND RESULTS OF THE SOFTWARE ARE ASSUMED BY YOU.  Attachmate does not warrant that: (A) the Software will meet your requirements, or (b) the operation of the Software will be uninterrupted, error free or that any defects will be corrected.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATTACHMATE AND ITS LICENSORS AND SUPPLIERS DISCLAIM ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE.  SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.  YOU MAY HAVE OTHER LEGAL RIGHTS, which VARY BY JURISDICTION.

LIMITATION OF LIABILITY.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATTACHMATE OR ITS LICENSORS AND SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION DIRECT DAMAGES, INDIRECT DAMAGES, SPECIAL DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, AND DAMAGES for lost profits, lost savings, LOSS OF USE, business interruption, loss of information OR DATA, DAMAGE TO EQUIPMENT, or other pecuniary loss) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ATTACHMATE OR ITS DEALERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

All title, patents, copyrights and any other intellectual property rights in and to the Software and any copies or portions thereof are owned and retained by Attachmate or its licensors and suppliers.  Except as provided in the second paragraph above, you may not copy or distribute the Software. You may not reverse engineer, decompile or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law.  Attachmate reserves all rights to the Software not expressly granted to you. Capitalized terms used in these supplemental terms and conditions and not otherwise defined herein shall have the meanings assigned to them in the License.
